1 Introduction and Scope

This policy covers all users who interact with H3D, Inc. or its affiliates (“H3D”, “we”, or “us”), all users who interact with the web services of H3D, Inc., accessible by internet starting from www.h3dgamma.com or h3dgamma.com (hereinafter the “Site”), and all users of the H3DTablet app (herein referred to as “Application”) as a Free service. This statement does not concern other websites that the user may consult through the use of a link.

This statement is prompted by European Union Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”). It describes H3D’s administrative procedures concerning the processing of its users’ personal data

2 Types of Personal Data Collected and Purposes for their Processing

Personally identifiable data will not be used by for any other scope different from that which has been indicated below.

2.1 Navigation data

The computer systems and software procedures enabling website operation acquire, during their normal operation, some personal data (so-called log files) the transmission of which is implicit in the use of internet communication protocols.

This information is not collected in order to be associated to identified data subjects, but due to its same nature can, by means of processing and integration with data held by third parties, allow users to be identified.

This category includes the IP addresses or domain names of the computers used by the users to connect to the website, URI (Uniform Resource Identifier) form addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the reply given by the server (done, error, etc.) and other parameters concerning the user operating system and computer environment.

These data are used with the purpose of obtaining anonymous statistical information concerning the use of the site and to check its correct operation. These data can be used to ascertain responsibility in the case of hypothetical computer crimes to the detriment of the website and can be communicated to law enforcement, in the event that the latter explicitly requests such data.

We also collect navigation data for purposes of administering, protecting, and improving our Site and our systems, to better understand the preferences of our Site visitors, to identify server problems, to compile aggregated statistics about Site usage, and to help personalize your experience of our Site.

Unless you also actively submit personal information such as your name or address, passively tracked data does not typically allow us to identify you personally (even though it can theoretically be done, we do not have the means or an interest to find out who you are, unless you identify yourself voluntarily through an active submission of data). To the extent permitted by applicable law, we reserve the right to combine passively tracked data with personal data that you actively submit.

The Site uses Google Analytics to gather, store and collate information about website visitors. It tells us how many unique visitors have been to a site, what pages they visited in what order, and for how long. If the Site was reached through an advertisement, it may tell us the keywords associated with that advertisement. The service only reports aggregate visitor data in anonymous form and does not collect personal information like addresses, names, or credit card numbers.

2.2 Personal Data Supplied by the User

The optional, explicit, and voluntary dispatching of electronic mail to the addresses indicated in this Site entails the subsequent acquisition of the sender address, necessary in order to reply to the requests, and also any other personal data contained in the message. When requesting information, literature or a service request from H3D, Inc., in person, via phone, through the contact form on our Site, or via another communication medium, we ask you provide us with details including your name, company, address, telephone, and email address necessary to respond to your inquiry.

We collect actively submitted data primarily for two purposes: first, for the purpose for which you originally sent us the data (e.g., to send information to you), and second, for purposes of informing you about products, services, and events. You can request to be removed from this list at any time, as described below.

2.3 Data Generated by Products

Data generated with the software, firmware, and hardware (the “Products”) sold, loaned, or demoed by H3D, Inc. may be recorded, stored, reproduced, processed, and inspected by H3D, Inc. for the purposes of maintenance and support, product development, and verification of compliance with applicable laws and regulations, including without limitation export and import laws and regulations. We may perform periodic due-diligence or other reviews of all data recorded, produced, or generated with the Products. This data will not be shared with third parties, with the exception of law-enforcement agencies, without your express consent.

2.4 Data Collected in the Application

The Application collects information when you download and use it. This information may include information such as

The Application collects your device's approximate geographical location, which helps to provide features such as Bluetooth and Internet connectivity within the Application.

None of this collected data is tied to a user name or other personal data.

3. How Your Data is Stored, Protected, and Shared

We employ reasonable security procedures to protect your personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. We also require that third-party service providers acting on our behalf also provide such reasonable security measures.

We may share your information with our agents and service providers who use the data only on our behalf and for our purposes under data-protection agreements. These include Google, Salesforce, HubSpot, Jotform, MailChimp, Amazon AWS, Microsoft Online Services, and A.N. Deringer. We may share your information to our employees, collaborators, and consultants only for the purposes described above.

When we ship you Products, we will share your address and contact information with our shippers, as required. These include YRC Freight for some shipments within North America and UPS, Nippon Express, FedEx, and DHL for domestic and international shipments. We share your personal data as required by law or in the interest of protecting or exercising our or others’ legal rights, e.g., in connection with requests from law-enforcement officials and in connection with court proceedings. We share or transfer your information in connection with a prospective or actual sale, merger, transfer, or other reorganization of all or parts of our business. Also, we reserve the right to fully use and disclose any information collected via the Site that cannot be linked to an identifiable individual.

Your details will not be passed to other third parties unless we have obtained your consent to do so or in exceptional circumstances where we are required or permitted to do so by law to comply with the legal process or to protect and defend the rights or property of H3D, Inc.

It is your responsibility to safeguard any password and User ID you use to access the Site or Application if any, and to notify us at info@h3dgamma.com if you ever suspect that this password or User ID has been compromised. You are solely responsible for any unauthorized use of the Site conducted via your password and User ID.

In the event of a data breach, we will notify you in a timely manner.

4. Data Subjects Rights

If you reside in the European Economic Area, your rights include: to receive confirmation of the existence of your personal data; to know its provenance as well as the reasoning and purpose of its processing; to obtain its cancellation, its transformation into anonymity (except to the extent we are required by applicable law to retain the data), as well as its updating, its amendment or its integration, if it is of interest; to oppose the processing for legitimate purposes; to oppose the use of this data for commercial, advertising or marketing information

Use of our services is purely voluntary and you do not need to provide personal data, but without certain personal data, you will not be able to fully use our services.

You can stop all collection of information by the Application easily by uninstalling it. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

5. Children's Privacy

The Site is intended for adults only. We do not intentionally or knowingly collect personally identifiable information from children under the age of 16 and we request that individuals under the age of 16 not submit any personal information on the Site.

H3D does not use the Application to knowingly solicit data from or market to children under the age of 13. The Application does not address anyone under the age of 13. H3D does not knowingly collect personally identifiable information from children under 13 years of age. In the case H3D discovers that a child under 13 has provided personal information, H3D will immediately delete this from their servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact H3D at dev@h3dgamma.com so that they will be able to take the necessary actions.

6. Effective Date, Amendments

This Privacy Policy is effective as of the date of its publication. We reserve the right to change this Privacy Policy from time to time and in our sole discretion. We reserve the right to change, modify, add or remove portions of this Privacy Policy at any time, but will alert you that changes have been made by indicating on the Privacy Policy the date it was last updated. When you visit the Site, the current version of this Privacy Policy as posted on the Site is the notice that applies, unless otherwise indicated under applicable law. We recommend that users revisit this Privacy Policy on occasion to learn of any changes.
